Terms of Service
plain and simple.

These Terms of Service ("Terms") form a binding legal agreement between you ("User", "you") and TheraSeek Technologies Private Limited ("Theraseek", "we", "us") governing your access to and use of the Theraseek mobile application and associated web services ("Service").

By downloading the app, creating an account, or joining the waitlist, you confirm that you have read, understood, and agree to these Terms in full. If you do not agree, do not use the Service.

These Terms, together with our Privacy Policy and any supplementary notices, form the complete agreement between you and Theraseek. In the event of conflict, these Terms prevail.

You may use Theraseek if you meet all of the following:

• You are 18 years of age or older; or aged 13–17 with documented parental consent
• You are a natural person (not a bot, corporation, or automated system)
• You have not previously been banned or removed from the Service by us
• You are using the Service for your own personal, non-commercial wellbeing only
• Your use complies with all applicable local, state, national, and international laws

Theraseek reserves the right to verify eligibility and to refuse or terminate access at any time if these conditions are not met. We are not responsible if someone provides false information about their age to access the Service.

Subject to these Terms, Theraseek grants you a personal, non-exclusive, non-transferable, revocable, limited licence to install and use the Theraseek app on a device you own or control, solely for your personal wellbeing use as permitted by the features of the Service.

You may not:

• Copy, distribute, sublicense, sell, or resell the app or any part of it
• Reverse engineer, decompile, or attempt to extract source code
• Use the Service to build a competing product or service
• Use automated means to access, scrape, or stress-test the Service
• Circumvent or interfere with any security or access control feature
• Share your account credentials with another person

Theraseek retains all rights not expressly granted in these Terms. This licence terminates automatically if you violate these Terms.

Theraseek is an AI-powered emotional support companion. Its purpose is to provide a private, non-judgmental space for reflection and self-expression. It uses techniques informed by evidence-based approaches (such as CBT and mindfulness), but these are self-help tools, not clinical treatment.

Theraseek is not appropriate for:

• Active suicidal ideation or self-harm planning
• Psychosis, dissociation, or severe psychiatric conditions
• Clinical eating disorders requiring medical monitoring
• Domestic abuse crises or situations requiring immediate safety intervention
• Substance dependency requiring clinical detox

If any of the above apply to you, please contact emergency services (112 in India) or a licensed mental health professional immediately. Theraseek's in-app crisis feature will surface helpline numbers if the app detects distress signals — but do not rely solely on this; call for help directly.

You use the Service at your own discretion and assume all responsibility for decisions made based on your sessions.

You agree to use Theraseek only for lawful, personal wellbeing purposes. You must not use the Service to:

• Attempt to probe, exploit, or manipulate the AI model for any purpose other than personal reflection
• Deliberately attempt to elicit harmful, illegal, or unethical outputs
• Share screenshots or recordings of Theraseek sessions in a manner that misrepresents the Service's capabilities
• Use the Service on behalf of another person without their consent
• Conduct independent research or clinical studies using the Service without explicit written permission from Theraseek
• Violate any applicable law or regulation

Theraseek reserves the right to suspend or terminate accounts where misuse is suspected, without prior notice and at its sole discretion.

Theraseek offers a 3-day free trial followed by a subscription plan at pricing published on the App Store/Play Store listing at time of signup. All prices are in INR and are inclusive of applicable taxes.

• Billing: Subscriptions are billed in advance on a monthly or annual cycle via the payment method you provide. Failure to pay may result in suspension of access.
• Trial cancellation: You may cancel during the free trial without charge. Cancellation must be made at least 24 hours before the trial ends to avoid the first billing.
• Refunds: We offer a full refund within 7 days of a first paid subscription charge if the Service is materially non-functional. After 7 days, no refunds are issued for partial billing periods. Refund requests: billing@theraseek.ai.
• Student discounts: Available on written verification. Apply at support@theraseek.ai with a valid student ID.
• Price changes: We will give at least 30 days' notice of subscription price changes via email and in-app notice.

All elements of the Theraseek application — including the app software, AI model weights, visual design, brand assets, character mascot, and written content — are the exclusive intellectual property of TheraSeek Technologies Private Limited, protected under Indian and international IP law.

Your conversation data, mood entries, and personal reflections generated through the Service belong to you. You grant Theraseek no rights to this content. Theraseek does not use your conversation data to train AI models.

If you believe any content on the Service infringes your intellectual property rights, notify us at legal@theraseek.ai with the subject line "IP Notice".

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.

Theraseek does not warrant that:

• The Service will be error-free, uninterrupted, or available at all times
• The AI companion's responses will be accurate, complete, or suitable for any specific purpose
• The Service will meet your individual mental health needs

To the maximum extent permitted by applicable Indian law, Theraseek's total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 3 months immediately preceding the event giving rise to the claim.

Theraseek is not liable for any indirect, incidental, consequential, or punitive damages, including loss of data, loss of goodwill, or personal injury resulting from use or inability to use the Service.

By you: You may terminate your use of the Service at any time by cancelling your subscription and deleting the app. To request deletion of account-level data we hold, email privacy@theraseek.ai.

By us: Theraseek may suspend or terminate your access with or without notice if you violate these Terms, if we suspect fraudulent or harmful use, or if we discontinue the Service entirely. If we discontinue the Service, we will provide at least 30 days' notice and pro-rata refunds for unused prepaid subscription time.

On termination, your licence to use the Service immediately ends. Sections 4, 7, 8, and 10 of these Terms survive termination.

These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and the Consumer Protection Act, 2019 where applicable.

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Kolkata, West Bengal, India. The language of arbitration shall be English.

Nothing in this clause prevents you from making a complaint to a consumer protection authority or the Data Protection Board of India.
